Privacy Policy
This is the privacy policy (“Privacy Policy”) that governs how we, X-trodes Ltd. and our affiliates and subsidiaries (“X-trodes”, “we”, “our” or “us”), use Personal Information (defined below) that we collect, receive and store about individuals in connection with the use of the website https://xtrodes.com/(“Site”), and any other website, platform, product or software that we operate, each, together with their sub-domains, content and services, which are individually and collectively referred to herein as the “Services”.
- We have implemented this Privacy Policy to explain you our privacy practices and the choices you can make about the way your Personal Information is collected and used by X-trodes. “Personal Information” means any information that may be used, either alone or in combination with other information, to personally identify an individual, including, but not limited to, a first and last name, a personal profile, an email address, a home or other physical address, or other contact information.
- Terms of Use. This Privacy Policy forms part of our Terms of Use which is available at Terms of Use(“Terms”). Any capitalized but undefined term in this Privacy Policy shall have the meaning given to it in the Terms.
- If you do not agree to this Privacy Policy, please do not access or otherwise use the Services. We reserve the right, at our discretion, to change this Privacy Policy at any time. If we make material or substantial changes, such changes will be effective ten (10) days following posting of the revised Privacy Policy on the Site (and/or the Services), and your continued use of the Services thereafter means that you accept those changes.
- What Personal Information We Collect and How We Collect It.
We do not currently require you to provide Personal Information in order to have access to general information available on the Site. But, we do receive and/or collect Personal Information from you in the following ways:
- Contact Us’ Information. If you send us a “Contact Us” request, whether by submitting an online form that we make available or by sending an email to an email address that we display. In such case, you will provide us with certain information such as your full name, email address and any other Personal Information you choose to provide us in your message/comments.
- Request to get a price quote. If you send us a request to get a price quote (e.g., in order to extend you research), you will provide us with certain information such as your full name, institute name, email address, phone number and any other Personal Information you choose to provide us in your message.
- Newsletter. If you send sign up for our newsletter, you will provide us your email address.
- Careers. If you submit a job application, whether by submitting an online form that we make available or by sending an email to us, you will provide us with certain information, such as your full name, email address, phone number, address, LinkedIn profile URL, professional experience, CV/Resume, and any other type of Personal Information you choose to provide us with.
- Marketing events and business cards. We collect Personal Data that you voluntarily provide, such as your full name, email address, company, job title, phone number as well as any other information that you decide to provide us with when: (i) you attend our marketing events (e.g., webinars), when we exchange business cards or when you contact us though our social media pages; and (ii) you use any of our social media channels such as LinkedIn and Facebook.
- User data. When you decided to register and make use of our Services, you may need to give us some Personal Information, for example, full name, email address, log-in details, as well as any other Personal Information that you decide to provide us with.
- Log Files. We may make use of log files. We may use such information to analyze trends, administer the Services, track users’ movement around the Services, and gather demographic information.
- Cookies and Other Tracking Technologies. Our Services may utilize “cookies”, anonymous identifiers and other tracking technologies in order to for us to provide our Services and present you with information that is customized for you. A “cookie” is a small text file that may be used, for example, to collect information about activity on the Services. Certain cookies and other technologies may serve to recall Personal Information, such as an IP address, previously indicated by a user. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. - The Site uses a tool called “Google Analytics” to collect information about use of the Service. Google Analytics collects information such as how often users visit the Service, what pages they visit when they do so, and what other sites they used prior to coming to the Service. We use the information we get from Google Analytics to maintain and improve the Service and our products. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to and use of the Service is restricted by the Google Analytics Terms of Service, available at http://www.google.com/analytics/terms/us.html, and the Google Privacy Policy, available at http://www.google.com/policies/privacy/. - Through our services, we allow third party advertising partners to set technologies and other tracking tools to collect information regarding your activities and your device (e.g., your IP address, website identifiers, page(s) visited, location, time of day). We also combine and share such information and other information (such as demographic information and past purchase history) with third party advertising partners. These advertising partners will use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit third party websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising. We allow access to other data collected by the services to share information that may be useful, relevant, valuable or otherwise of interest to you. If you prefer not to share your Personal Information with third party advertising partners, you may let us know.
- The Purposes for which We Collect and Use your Personal Information. Legal Basis.
- If you submit or we collect Personal Information through the Services, then we may use such Personal Information for the following purposes:
- To provide you with the Services. We will use your Personal Information to provide and improve our Services. For example, we use your designated email address to: (i) send you updates or news regarding the Services and our products; and/or (ii) respond to a “Contact Us” or administrative request (for example, to change your password). Additionally, we use your Personal Information to contact you in connection with the Services and certain programs or offerings that you may have registered for, and to identify and authenticate your access to the parts of the Services that you are authorized to access. We will also use your Personal Information for (i) internal quality control purposes; (ii) to establish a business relationship; (iii) to generally administer the Services; (iv) to customize your Services and experience with us; (vi) to negotiate and execute an agreement with you; and (v) to provide you maintenance and support.
- To market the Services. We use Personal Information to market our Services. Such use includes (i) notifying you about offers and services that may be of interest to you; (ii) tailoring content, advertisements, and offers for you, including, targeting and re-targeting practices; (iii) conducting market research; (iv) developing and marketing new products and services, and to measure interest in the Services; (v) other purposes disclosed at the time you provide information; and (vi) as you otherwise consent or authorize us to do so.
- Security purposes. Some of the abovementioned information will be used for detecting, taking steps to prevent and prosecuting fraud or other illegal activity; to identify and repair errors; to conduct audits; and for security purposes. Information may also be used to comply with applicable laws, with investigations performed by the relevant authorities, law enforcement purposes, and/or to exercise or defend legal claims.
- De-identified and aggregated information use. In certain cases, we anonymize or de-identify your Information and further use it for internal and external purposes, including, without limitation, to improve our services and products and for research purposes. We use this anonymous or de-identified information and/or disclose it to third parties without restrictions (for example, in order to improve our services and enhance your experience with them).
- If you submit or we collect Personal Information through the Services, then we may use such Personal Information for the following purposes:
At all times, you may choose whether or not to provide or disclose Personal Information. If you choose not to provide mandatory Personal Information, you may still visit parts of the Services but you may be unable to access certain options, programs, offers, and services that involve our interaction with you.
- Under the General Data Protection Regulation (EU) 2016/679 (“GDPR“), the lawful bases we rely on for processing Personal Information are:
- Your consent. For example: when we place cookies on your browser or before sending you marketing communications.
- Performance of a contract. For example: when we collect your Personal Information and use it in the context of the Services.
- When we have a legal obligation. For example: when we keep the Personal Information of our customers in order to comply with our tax or record-keeping obligations.
- When we have a legitimate interest. For example: when we collect your Personal Information on our Site in order to respond to a “Contact Us” or administrative request.
- Customer Data.
- X-trodes has a contractual relationship with its customers (“Customer”). In the context of the Services, the Customer can upload (at the customer’s discretion) information and Personal Data (“Customer Data”).
- For the avoidance of doubt, X-trodes is considered a “Processor” and the Customer a “Controller” (as both such capitalized terms are defined in the European Union General Data Protection Regulation) of such Customer Data. Customer is responsible for the security, integrity and authorized usage of Personal Data in the context of the Services, and also for obtaining consents, permissions and providing any required data subject rights and fair processing notices required for the collection and usage of such Personal Data. Please note that X-trodes does not have any contractual relationship with the data subject, therefore, X-trodes’ Customer are the responsible party for complying with all laws and regulations (including, without limitation, privacy laws) that apply to the collection and use of the Customer Data. If you have any question about your Personal Data, please contact the Customer directly.
- The Way We Share your Personal Information.
- We may transfer your Personal Information to our local or foreign subsidiaries or affiliated companies for the purpose of storing or processing such information on our behalf.
- We may share your Personal Information with our third party service providers and partners, to assist us with our business internal operations and to provide our Services to you and other users. Such information may be transferred to other countries. The service providers implemented by us, include, without limitation, the following:
- Cloud service providers for hosting purposes;
- Websites and web content creation platforms in order to help us manage our Site;
- Email providers, marketing, CRM, other similar tool providers and/or sales software;
- Analytic companies, in order to help us understand and analyze information we collect;
- Billing companies;
- Data enrichment companies; and/or
- Partners and distributors.
- Regardless of where such third party service providers are located (and some are located in the US), their servers may be located anywhere in the world (including the US). To the maximum extent permitted by law, you are consenting to your data being transferred to the mentioned third party service providers around the world (including the US).We may disclose your Personal Information or any information you submitted via the Services if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request or if required to do so by court order; (ii) enforce our Terms, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of X-trodes, our users, yourself or the public.
- Where you have provided your consent to us sharing or transferring your Personal Information.
- Additional Information Regarding Transfers Of Personal Information
- Storage: We store the Personal Information with the following storing companies: AWS – North Virginia – U.S. and in 365 servers.
- External transfers: Where we transfer your Personal Information outside of EU/EEA (for example to third parties who provide us with services), we will generally obtain contractual commitments from them to protect your Personal Information. When X-trodes engages in such transfers of Personal Information, it relies on i) Adequacy Decisions as adopted by European Commission on the basis of Article 45 of the GDPR (for example, when we access from Israel), or ii) Standard Contractual Clauses issued by the European Commission. X-trodes also continually monitors the circumstances surrounding such transfers in order to ensure that these maintain, in practice, a level of protection that is essentially equivalent to the one guaranteed by the GDPR.
- Your Privacy Rights.
- Rights: The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by the GDPR):
- You have a right to access Personal Information held about you. Your right of access may normally be exercised free of charge, however we reserve the right to charge an appropriate administrative fee where permitted by applicable law;
- You have the right to request that we rectify any Personal Information we hold that is inaccurate or misleading;
- You have the right to request the erasure/deletion of your Personal Information (e.g. from our records). Please note that there may be circumstances in which we are required to retain your Personal Information, for example for the establishment, exercise or defense of legal claims;
- You have the right to object, to or to request restriction, of the processing;
- You have the right to data portability. This means that you may have the right to receive your Personal Information in a structured, commonly used and machine-readable format, and that you have the right to transmit that data to another controller;
- You have the right to object to profiling;
- You have the right to withdraw your consent at any time. Please note that there may be circumstances in which we are entitled to continue processing your data, in particular if the processing is required to meet our legal and regulatory obligations. Also, please note that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
- You also have a right to request certain details of the basis on which your Personal Information is transferred outside the European Economic Area, but data transfer agreements and/or other details may need to be partially redacted for reasons of commercial confidentiality; and/or
- You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place of alleged infringement) at any time or before the relevant institutions in your place of residence. We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority and/or relevant institution.
- Additional information regarding your rights: You can exercise your rights by contacting us at [email protected]. You may use an authorized agent to submit a request on your behalf if you provide the authorized agent written permission signed by you. To protect your privacy, we may take steps to verify your identity before fulfilling your request. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable law or inform you if we require further information in order to fulfil your request. When processing your request, we may ask you for additional information to confirm or verify your identity and for security purposes, before processing and/or honoring your request. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.
- Unsubscribe from marketing emails: You may choose not to receive future promotional, advertising, or other Services-related emails from us by selecting an unsubscribe link at the bottom of each email that we send. Please note that even if you unsubscribe of receiving the foregoing emails, we may still send you a response to any “Contact Us” request as well as administrative emails that are necessary to facilitate your use of the Services.
- Rights: The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by the GDPR):
- Links to and Interaction with Third Party Products. The Services may enable you to interact with or contain links to your Third Party Account and other third party websites, mobile software applications and services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services may collect Personal Information from you. Accordingly, we encourage you to read the terms and conditions and privacy policy of each Third Party Service that you choose to use or interact with.
- Children’s Privacy. The Services are not structured to attract children under the age of 18 years. Accordingly, we do not intend to collect Personal Information from anyone we know to be under 18 years. If you are under the age of eighteen (18), do not provide any Personal Information to us without involvement of a parent or a guardian. For the purposes of the GDPR, we do not intend to offer information society services directly to children. If we learn that we have collected Personal Information from a child under 18 years, we will delete that information as quickly as possible. - How we protect and retain your Personal Information.
- Security. The security of Personal Information is important to us. We follow generally accepted industry standards, including the use of appropriate administrative, physical and technical safeguards, to protect the Personal Information submitted to us. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use reasonable acceptable means to protect your Personal Information, we cannot guarantee its absolute security or confidentiality. - Retention of your Personal Information. Your Personal Information will be stored until we delete the record and we proactively delete it or you send a valid deletion request, please note that in some circumstances we may store your Personal Information for longer periods of time, for example (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Information or dealings.
- Merger, Sale or Bankruptcy. If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we will disclose your information to such third party (whether actual or potential) in connection with the foregoing events (including, without limitation, our current or potential investors). In the event that we are acquired by or merged with a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign Personal Information in connection with the foregoing events.
- California Privacy Rights. California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to [email protected]. Please note that we are only required to respond to one request per customer each year.
- Our California Do Not Track Notice. Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers, but we may allow third parties, such as companies that provide us with analytics tools, to collect personally identifiable information about an individual consumer’s online activities over time and across different web sites when a consumer uses the Services.
